I am a foreign submitter, as in non us citizen not living in USA. I live in a country WITH a tax treaty with the US and I filled out the W8something when that was required.

Now suddenly I get some nonsense about submitting my tax returns to the US and just got some two letters in the mail today about filing my tax return for 2011 ????

What is that all about and why am I getting this now when I already filled out and submitted this W8n..... form to be rid of exactly this ?

I thought the purpose of a tax treaty was exactly to free me from doing tax returns twice ?

Can someone explain this to me please

This is some form that Shutterstock sent to me, two letters in fact, one sent from ss spv llc and the other from Shutterstock.

 

Both forms are type 1042-S

Different amounts are stated on them but both are code 12 income (royalties) Both state a tax rate of 0 and exemption code 04 (exempt under tax treaty)

Now I cant see on this form that anything was withheld so things are as they should be regarding that. But I am confused as to what I am supposed to do with this ?

 

Shutterstock and the other company has already filled some of the fields out.

 

Am I supposed to fill out the rest and send this somewhere ?

 

Can someone explain this to me ?

 

p.s I know that at least one other submitter has received the same papers from shutterstock. But no other stock agency has sent anything regarding this.

Again....

 

I am a member of a country with a tax treaty of 0 with the us, as in I dont pay ANY taxes there.

 

I already submitted the W8n forms a long time ago through Shutterstock.

Now suddenly SHUTTERSTOCK sent me 1042-s forms filled out with info from Shutterstock. Now I am not asking whether or not I should file taxes in the US, since I KNOW I dont need to. I am asking what I am supposed to do with these forms that SHUTTERSTOCK sent me !!!

 

You sent these forms so you must know what the hell I am to do with them, unless shutterstock is in the habit of sending submitters and customers random forms just for fun. There are NO tax specialist in MY COUNTRY that have the slightest clue as to what to do about forms and filings regarding the US IRS.

The US embassy told me to ask you guys, since you sent this to begin with.

so please respond in a meaningful manner and help me find out what I am to do with this.

Hello I am in exactly the same situation. I've got the 1042-S form by mail recently althought I live in the country with tax treaty with US (0%). And I have already filed W-8BEN form...So my question is what I have to do with this received 1042-S form???

P.S. I've already checked forums and ss tax center and didn't find the answer to my question.

I received the same filled form also.

 

I found official instructions from IRS.

Maybe this can help..

You can read somewhere that:

---------------------------------------------------------------------

Every withholding agent (defined in Definitions, later) must file an information return on Form 1042-S to report amounts paid during the preceding calendar year that are described under Amounts

 

and

 

Attach only Copy A to Form TIP 1042-T. Copies B, C, and D

should be provided to the recipient of the income.

as I understand shutterstock have to fill one of this form for every foreign contributor, to file it to IRS and to send a copy (Copy B) to every contributor..

 

Normally you have to put this income info into the TAX declaration of your country but if your country have a tax treaty with US then you have nothing to do then..
