images used in a calendar

Hi guys,

 

I was just wondering, is it true that SS terms of use only allow the use of images being printed in calendars when the buyers purchased an enhanced license? Because I found 4 of my images on calendars (sold in 5 languages all over the world) and I never got an enhanced license for any of them.

Can somebody help?

thanks for your reply, that's what I thought. Actually there are a whole lot of other SS images on these calendars, so SS must have missed out on quite some money, as well as the submitters...

I did e-mail support, but since I didn't get a reply yet I thought I might just as well post here.

As Andrea said, she is looking into this issue. With the holidays, things can take a little longer. When we resolve this we will let you know if we feel it is necessary.

 

If you feel it is necessary? Please tell me that was a typo. I would expect a response like that from someone at IS but not from you Seth. When an issue regarding misuse of a submitters image is resolved it should always be nesessary to inform the submitter of the resolution. Afterall the resolution has a DIRECT impact on the submitter / copyright owner. Is shutterstock really getting so big and arrogant as to presume that we as submitters are not so important a part of the big picture that we should be kept in the loop?

 

BTW I do have a personal vested interest in the resolution of the issue now as this company is using one of my images in THIS CALENDAR and unlike the average submitter here my image copyrights are registered

well, I was pretty upset with that reply as well. Those guys are using 4 of my images, they didn't purchase an enhanced license for any of them, and they're selling their calendars in 5 languages all over the world. Since this is not within SS 'Terms of use' I'm wondering what these terms of use are for. Because they don't really help me as a submitter in such cases anyway, do they.

I'm sorry -- I misspoke. what i meant was that, as you know, we dont usually find it necessary or appropriate to respond to matters like this in the forums -- we consider these situations private and handle them privately with each submitter involved. We take copyright issues very seriously and we will always respond and begin our investigation within 24 hours when details are sent to support@shutterstock.com.

Well, I'm glad to hear there is some progress in the back at least - all I'm seeing is that avonsidepublishing uses another 4 of my photos for the 2009 calendars. That seems like a joke to me...

 

What I'd really like to know is: 2008 and 2009 APL used at least 8 of my images that have been purchased from shutterstock.com (not even one single EL!)

Am I getting any refund for that or what can I expect at all?
